Terms & Conditions

For Them is a social gifting and celebration platform.

The Service may allow people to:

• create and share wishes;
• create and join circles;
• remember important occasions;
• invite family and friends;
• contribute toward wishes;
• send messages and appreciation;
• celebrate people they care about;
• request fulfillment of wishes.

Features may change as For Them develops.

You agree to provide accurate information and keep your account information reasonably up to date.

You are responsible for activity through your account and should keep your login credentials secure.

You may not impersonate another person or create an account using information that you are not entitled to use.

For Them is designed to be useful to families, including celebrations and wishes involving children.

A parent or guardian may create or manage wishes, occasions or profiles involving a child.

Users who are not legally able to consent to use of the Service on their own may only use For Them with the involvement or permission of a parent or legal guardian as required by applicable law.

Where parental consent is required by law, For Them may require confirmation or verification of that consent.

Payment functionality may be restricted based on age, location or other legal requirements.

A Wish represents something a person would like to receive, experience or achieve.

A Wish may include:

• a title;
• description;
• image;
• product or service link;
• estimated price;
• preferences;
• an associated occasion.

The amount shown for a Wish may represent an estimated amount required to fulfill that Wish and may take into account costs such as the product or service itself, applicable retailer taxes, delivery or other direct fulfillment costs.

Wish prices are estimates unless otherwise expressly stated.

Product prices, availability, taxes, shipping costs and other circumstances may change.

Creating or sharing a Wish does not guarantee that it will be funded or fulfilled.

Users may be able to make payments toward a Wish (“Contributions”).

Contributions are voluntary and are intended to help make a particular Wish come true.

Contribution amounts are associated with the relevant Wish and may be used toward reasonable costs required to fulfill that Wish, including the cost of the product or service, retailer taxes, shipping, delivery or other direct fulfillment costs.

A Contribution is not:

• a bank deposit;
• an investment;
• a charitable donation;
• a personal savings account;
• a cash transfer to the recipient;
• a withdrawable wallet balance.

For Them may hold Contribution amounts while a Wish is awaiting an occasion, reveal, recipient action or fulfillment.

Contribution amounts are separate from any Service Fee charged by For Them.

Before completing a payment, you will be shown the amount to be charged and any fees or applicable taxes that apply.

Payments are processed through independent payment service providers.

For Them does not store complete payment card numbers or card security codes.

Payment providers may process information in accordance with their own terms and privacy policies.

A payment may be declined, reversed, refunded or disputed according to applicable payment-provider rules and applicable law.

Where For Them charges a separate Service Fee, that fee will be identified separately from the Contribution amount.

Any taxes that For Them is legally required to collect in connection with its own fees or services will be shown where applicable.

When appropriate, For Them may arrange fulfillment of a Wish.

Fulfillment may involve:

• contacting the recipient;
• confirming what the recipient wants;
• confirming delivery information;
• selecting a retailer or provider;
• purchasing a product or service;
• arranging delivery;
• coordinating an alternative where the original Wish cannot reasonably be fulfilled.

Some fulfillment may be handled personally by the For Them team as part of our concierge service.

By requesting fulfillment, the recipient authorizes For Them to use the Contribution amounts associated with the Wish to arrange and purchase the relevant product or service and to pay reasonable direct fulfillment costs associated with it.

Our goal is to make fulfillment simple and thoughtful rather than simply transfer money.

Sometimes things change.

A product may sell out.

A price may increase.

A requested colour or model may disappear.

A retailer may not deliver to the recipient’s location.

If this happens, we may work with the recipient to find a reasonable alternative or another way to fulfill the Wish.

If the amount available for a Wish is insufficient to complete fulfillment, we may allow additional Contributions, propose an alternative, or otherwise work with the recipient to determine an appropriate solution.

If the final fulfillment cost is lower than the amount available for the Wish, any unused amount will continue to be handled in connection with the Wish in accordance with the options made available by For Them and applicable law.

We cannot guarantee that every Wish can be fulfilled exactly as originally described.

Recipients are responsible for providing accurate delivery information where delivery is required.

We may ask the recipient to confirm the delivery address before placing an order.

Once an order has been placed, changing the delivery details may not always be possible.

Delivery estimates may depend on retailers, carriers and other third parties outside our control.

We will make reasonable efforts to help resolve fulfillment and delivery problems.

Refund availability depends on the circumstances.

This may include:

• whether the Contribution has already been committed toward fulfillment;
• whether an order has already been placed;
• retailer return policies;
• payment-provider rules;
• applicable consumer-protection laws.

Where a Contribution has not yet been committed toward fulfillment, For Them may consider reasonable cancellation or refund requests.

Where a Wish cannot reasonably be fulfilled, For Them may cancel the fulfillment and refund eligible unused Contribution amounts to the original payment method.

Once a product or service has been purchased, returns, exchanges and refunds may depend on the applicable retailer or provider policy in addition to applicable law.

Nothing in these Terms limits rights that cannot legally be limited under applicable consumer-protection law.

For Them may allow users to invite family members, friends and other people they know.

Please only invite people with whom you have a genuine relationship or reasonable reason to communicate.

You may not use For Them invitations for:

• spam;
• mass unsolicited marketing;
• harassment;
• impersonation;
• unrelated commercial promotion.

Users may submit content such as:

• wishes;
• photos;
• contributor messages;
• appreciation messages;
• profile information;
• comments or other communications.

You continue to own your content.

You give For Them permission to store, process and display that content as reasonably necessary to operate the Service and provide the experience you requested.

You are responsible for making sure that you have the right to share content you upload.

For Them exists to bring people closer together.

Please use it accordingly.

You must not use For Them to:

• deceive or defraud people;
• harass or threaten others;
• impersonate someone;
• make unauthorized payments;
• violate another person’s privacy;
• infringe intellectual-property rights;
• introduce malicious software;
• interfere with the Service;
• misuse another person’s account;
• conduct unlawful activity.

We may remove content or restrict accounts where reasonably necessary to protect users, the Service or For Them.

For Them may rely on third parties such as:

• payment processors;
• retailers;
• delivery providers;
• hosting providers;
• analytics providers;
• communications providers.

These providers may have their own terms and privacy practices.

For Them is not responsible for independent third-party services outside our reasonable control.

The For Them name, branding, software, design and original materials are owned by or licensed to For Them Technologies Inc.

Using For Them does not transfer ownership of those rights to you.

Your privacy matters to us.

Our collection and use of personal information are described in our Privacy Policy.

We may contact you about activity relating to the Service, including:

• account activity;
• invitations;
• Contributions;
• occasions;
• wishes;
• fulfillment;
• delivery;
• security;
• support.

Where required by law, promotional communications will be subject to appropriate consent and unsubscribe options.

You may stop using For Them at any time.

We may restrict or suspend an account where reasonably necessary because of:

• suspected fraud;
• misuse;
• security concerns;
• violations of these Terms;
• legal requirements.

Users may request account deletion, subject to records we must retain for transactions, accounting, fraud prevention, legal compliance or dispute resolution.

For Them is an evolving service.

We may add, modify or remove features.

We cannot promise that the Service will always be uninterrupted or error-free.

Where a change affects an existing paid transaction or active fulfillment, we will make reasonable efforts to complete it or provide an appropriate solution.

To the maximum extent permitted by law, For Them is not responsible for indirect or consequential losses resulting from use of the Service or circumstances beyond our reasonable control.

Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded or limited.

We may update these Terms as For Them develops.

If we make a material change, we may notify users through the Service, by email or by another reasonable method.

The Effective Date at the top shows when the current version took effect.

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, subject to mandatory rights that may apply where you live.
